This Privacy Notice describes the types of information we collect from you when you visit gyldfinance.com (the "Site") and/or use the features available on it, including our partner and investor interest form (together with the Site, the "Services"). It also explains how we process, transfer, store, and disclose the information collected, and how you can control certain uses of that information.
"Personal Data" means any information that relates to an identified or identifiable individual, or as otherwise defined by applicable law. "You" means any visitor to and/or user of the Site and/or Services.
01Personal Data we collect, uses, and legal basis
Depending on how you use the Site, we collect different types of data, and we and our third-party service providers use the data we collect for different purposes, as set out below. You are under no legal obligation to provide us with Personal Data, but if you choose not to, we may be unable to respond to your inquiry or provide you with the Services or parts of them.
1.1. Contact and interest form information
When you submit our partner and investor interest form, contact us by email, or request information from us for any other reason, we collect the data you provide. This may include your name, work email address, organization, role or title, organization type, jurisdiction, indicative allocation size, timeline, Telegram handle, confirmations you provide regarding your investor status, and the content of your message.
How we use this data: to evaluate and respond to your inquiry, to assess eligibility and suitability for participation in our products and partnerships, to manage our commercial pipeline, and, where you have agreed, to send you updates about Gyld.
Legal basis: performance of a contract or steps taken at your request prior to entering into a contract, when we respond to your inquiry; our legitimate interests in operating and developing our business, including maintaining records of commercial relationships; and compliance with legal obligations, including verification of investor eligibility and jurisdiction where required.
1.2. Automatically collected data
When you visit the Site, certain information about your device may be collected automatically by our hosting infrastructure, including non-Personal Data such as browser type and operating system, and Personal Data such as your IP address. For more information about cookies and similar technologies, please see Section 8 below.
How we use this data: (1) to provide you with the Site and Services; (2) to review usage and operations in an aggregated, non-identifying manner and improve the Site; and (3) to prevent fraud, protect the security of the Site and Services, and address technical problems.
Legal basis: performance of a contract when processing is necessary to deliver the Site; our legitimate interests when processing is for security, fraud prevention, and improvement of the Services; and your consent where required for non-essential cookies or analytics.
02Additional uses
2.1. Statistical information and analytics
We and/or our service providers may use analytics tools to collect and analyze information about use of the Site, such as how often visitors arrive and which pages they view. By analyzing this information we may compile aggregated statistical information that helps us improve the Site, understand trends, and develop our products and services. Aggregated information of this kind is anonymous and is not linked to your Personal Data.
2.2. Direct marketing
We may use your contact details to let you know about Gyld products and Services that we believe will be of interest to you, where you have agreed to receive such communications or where otherwise permitted by law. We will limit direct marketing to a reasonable and proportionate level. If our marketing activities are based on your consent, you may withdraw that consent at any time.
03Sharing the Personal Data we collect
We share your information, including Personal Data, as follows:
3.1. Group entities
We may share your Personal Data with entities within the Gyld corporate group, including Gyld Capital Markets Ltd (Jersey), where this is necessary to evaluate your inquiry, provide you with our products and Services, or manage our business. Such data will be processed in accordance with this Privacy Notice.
3.2. Service providers and subcontractors
We disclose information to trusted service providers and subcontractors who are subject to confidentiality obligations and who use such information solely on our behalf in order to help us provide the Site and Services. These include providers of website hosting and form processing (currently Netlify, Inc.), IT and system administration, security, storage, communications, and data analysis. We may also share your information with our professional advisers, including lawyers, auditors, and compliance providers, where necessary.
3.3. Business transfers
Your Personal Data may be disclosed as part of, or during negotiations of, any merger, financing, sale of company assets, or acquisition, including in cases of reorganization or liquidation. In such cases, your Personal Data will continue to be subject to the provisions of this Privacy Notice.
3.4. Legal and regulatory disclosure
We may share your Personal Data with third parties: (i) if we believe in good faith that disclosure is appropriate to protect our or a third party's rights, property, or safety, including enforcement of this Privacy Notice; (ii) when required by law, regulation, subpoena, court order, or a request from a regulatory, governmental, or law enforcement authority; or (iii) as necessary to comply with any legal or regulatory obligation, including anti-money-laundering and sanctions requirements.
04International transfers
We use service providers, and have group entities and advisers, located in countries other than your own, including the United Kingdom, Jersey, Switzerland, and the United States, and we may send them information we receive, including Personal Data, for the purposes described above.
Whenever we transfer your Personal Data outside of the United Kingdom or the European Economic Area, and where required by applicable law, we ensure a similar degree of protection is afforded to it by implementing at least one of the following safeguards: transferring only to countries deemed to provide an adequate level of protection for Personal Data; or entering into contracts that include standard contractual clauses approved under applicable data protection law. 05Security

06Your rights
Subject to applicable law and certain exemptions, and in some cases depending on the processing activity we are undertaking, you have certain rights in relation to the Personal Data we hold about you. We will make every reasonable effort to honor requests as quickly as possible and within the timescales provided by applicable data protection law. We may ask for reasonable evidence to verify your identity before complying with a request.
- Right of access. You have a right to know what Personal Data we hold about you and, in some cases, to receive a copy of it.
- Right to data portability. Where processing is based on your consent or a contract with you and is carried out by automated means, you may be entitled to receive the Personal Data you provided to us in a structured, commonly used, machine-readable format.
- Right to correction. You may request that we update, complete, or correct inaccurate, incomplete, or outdated Personal Data.
- Right to deletion. You may request that we delete your Personal Data where it is no longer needed for the purpose for which it was collected, where you have withdrawn consent on which processing was based, where you have successfully objected to processing, where processing was unlawful, or where deletion is required for compliance with a legal obligation. We may retain certain Personal Data for audit, record-keeping, or legal purposes as permitted by applicable law.

07Data retention

We may delete information from our systems without notice once we deem it no longer necessary for those purposes, and we require our processors to delete Personal Data when they no longer require it.
